Basically, an immigration attorney is the one who defends on behalf of or against client in immigration cases. The cases undertaken by an attorney can be of various kinds and from various fields. Such attorneys will either work for the government or as a prosecutor, where the defendant is a criminal immigrant. A lot of attorneys specialize in the field of immigration cases that involves foreign employees.
Whichever field an attorney chooses to specialize in, his or her salary will vary depending on various factors like experience of the attorney, the location in which he is practicing, competence, success rate, qualification, the law firm which he belongs to etc.
As mentioned before, he can choose to work for the government and bring cases of immigration. In such cases, the attorney might have to work as a prosecutor. Since these attorneys are working for the government, the government authorities set their pay rate. The salary paid to those working under the government will vary according to his or her experience. As they become more experienced, with each passing year their salary could also increase. In many cases, an attorney represents the defendant in immigration cases. The defendants are usually those individuals, who are trying to avoid deportation for some reason and hence, need a private attorney to represent them in court. The defendants usually have two options, either to represent themselves in immigration court or to hire an attorney. Since defending self has little chance of winning the case, defendants prefer to hire a private attorney. A private attorney charges varying amount of fees from their clients. It usually depends on their repute and the number of cases they have worked on.
There are a lot of nonprofit organizations that work for the welfare of the immigrant community. Such nonprofit organizations usually aim for those low-class and low-income earners, who cannot hire a good immigration attorney to represent themselves in the court. An attorney working in such organization will also work on various family cases as well. For such attorneys, their salary is decided by the particular organization they work for, and it is possible that they may not be paid more.
There are attorneys, who also work as solo practitioners. They practice alone, or hire a couple of attorneys to assist him. The salary of a solo practitioner depends on various factors, including how much he is able to earn from his clients or how much his firm is willing to pay him. Entry level immigration attorney willing be earning less than the experienced attorney. Those independent firms, who have good marketing strategies, will earn more. It all depends upon the firm’s resources and the budget it can spend on salaries of its workers as well as their marketing strategies. It also depends on the competition prevailing in their area. For instance, if there are many equally reputed firms in the same location, they may get less profit on the other hand if it is the only reputed firm in their locality, the profits will be high.
Therefore, there are no hard and fast rules pertaining to the salary of attorney, and it generally depends upon the various factors.
